Notwithstanding, National Center for Homeopathy may impose restrictions on its distributions of funds to ensure that the funds distributed will be spent for charitable purposes and in accordance with U.S. federal tax rules and regulations. National Center for Homeopathy cannot guarantee that any such restrictions on its distributions will be honored, but National Center for Homeopathy does reserve the right to request a return or repayment of any misapplied funds.
All donations made through the Services are processed by the National Center for Homeopathy, which partners with third-party payment processors Stripe and PayPal (the “Third Party Payment Processors”; each a “Third Party Payment Processor”) to securely manage the financial transaction process in exchange for charging the user a transaction fee for each donation. Each donation amount is reduced by this transaction fee. National Center for Homeopathy does not receive any of the proceeds from the fee that the Third Party Payment Processor charges. Information about the Third Party Payment Processor transaction fees is available at Stripe.com and Paypal.com. National Center for Homeopathy is not liable for the manner in which the Third Party Payment Processor processes any donation made through the Services. All contributions made through the Services are complete and final charitable contributions to National Center for Homeopathy and are not refundable, and they are complete upon submission through the Third Party Payment Processor.
Notwithstanding any of these Terms, National Center for Homeopathy reserves the right, without notice and in its sole discretion, at any time and from time to time to modify, suspend or discontinue, temporarily, or permanently, the Services (in whole or in part). National Center for Homeopathy reserves the right to delete, edit, or modify any and all User Content contained in the Services at any time without notice and in its sole discretion. National Center for Homeopathy may suspend or remove you from National Center for Homeopathy Services without prior notice for any reason or no reason at our sole discretion. You agree that National Center for Homeopathy will not be liable to you or any third party for any modification, suspension, or discontinuance of National Center for Homeopathy Services.
If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable, then such provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. No waiver of any of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
19. Children Under 13 Years of Age
The Services are not directed at children under 13 years of age nor does National Center for Homeopathy knowingly collect information from children under 13. Children under the age of 13 should not submit any personally identifiable information to National Center for Homeopathy nor attempt to use the Services without parental supervision and approval.
20. Applicable Laws
National Center for Homeopathy controls and operates the Services from the United States. National Center for Homeopathy makes no representation that materials and/or content available via the Services are appropriate or available for use in all jurisdictions, and access to the Services from territories where its materials and/or content are illegal is prohibited. You may not use, export, or re-export materials and/or content available via the Services or any copy or adaptation thereof in violation of any applicable laws or regulations including, without limitation, U.S. export law and regulations. Those who choose to access the Services from other locations do so on their own initiative and are responsible for compliance with applicable local laws.
The section titles of these Terms are displayed for convenience only and have no legal or contractual effect. The failure of National Center for Homeopathy to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms or any incorporated documents are found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should attempt to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect. You agree that, except as otherwise expressly provided in these Terms, there will be no third-party beneficiaries to this agreement.
National Center for Homeopathy reserves the right to take any legal or technical remedies to prevent the violation of these Terms and to protect National Center for Homeopathy, the Services, users, and the rights and property of National Center for Homeopathy.
We may assign our rights and delegate our obligations under these Terms, in whole or in part, at any time with or without notice to you. You may not assign any of your rights or delegate your obligations under these Terms to any other person. Any attempt by you to do so is void.
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Services or these Terms must be filed within one (1) year after such claim or cause of action arose or be forever barred. If any provision provided under these Terms is found invalid or unenforceable, the provision will be enforced to the maximum extent permissible and the other provisions and Terms hereof will remain in force.
22. Changes to the Terms
National Center for Homeopathy reserves the right to change or modify any of the terms and conditions contained in the Terms or any policy or guideline of the Services, at any time and in National Center for Homeopathy’s sole discretion. Any changes or modification will be effective immediately upon posting of the revisions to the Services via the Site. Your continued use of the Services following the posting of changes or modifications will constitute your acceptance of such changes or modifications. Therefore, you should frequently review the Terms and applicable policies from time to time to understand the terms and conditions that apply to your use of the Services. If you do not agree to the amended terms, you must stop using the Services.
23. No Employment Created
These Terms do not create an employment, agency, partnership, or joint venture relationship between you and National Center for Homeopathy.
If you have not signed a separate agreement with National Center for Homeopathy, these Terms constitute the entire agreement between you and National Center for Homeopathy. If there is any conflict between these Terms and a signed written agreement between you and National Center for Homeopathy, the signed agreement will control. These Terms do not alter in any way the terms or conditions of any other agreement you may have with National Center for Homeopathy. If you are using the Services on behalf of any entity, you represent and warrant that you are authorized to accept these Terms on such entity’s behalf, and that such entity agrees to indemnify you and National Center for Homeopathy for violations of these Terms.
You understand that, unless otherwise agreed to in writing by National Center for Homeopathy, you have no expectation of compensation for any activity, contribution, or idea that you provide to National Center for Homeopathy via the Services.

24. Use of the National Center for Homeopathy (NCH) Logo
Please note that NCH does not provide a seal of approval or independent certification for any product or service. UNAUTHORIZED USE OF THE NATIONAL CENTER FOR HOMEOPATHY (NCH) LOGO IS STRICTLY PROHIBITED.
Here at the National Center for Homeopathy (NCH) we do encourage members and donors to promote NCH on their website and/or in their newsletters. Authorization must be provided in writing from an official NCH representative.
We require that members and donors use wording as follows:
- Learn more about homeopathy at www.homeopathycenter.org.
- Get connected to the resources you seek and learn more at www.homeopathycenter.org.
- Homeopathy changes lives. NCH empowers homeopathy education. Learn more at www.homeopathycenter.org.
- Proud Supporter of National Center for Homeopathy www.homeopathycenter.org.
- NCH is an open-membership organization. Join today www.homeopathycenter.org.
- The mission of the National Center for Homeopathy (NCH) is to provide education and build awareness while advocating for access to homeopathy. Join today www.homeopathycenter.org.
For current members in good standing that would like to add mention of their NCH membership, we ask for everyone to:
- Please be careful not to give the impression that NCH accredits businesses or professional homeopaths.
- Practitioners should not list the NCH alongside professional organization logos, certifying bodies, or in a section of your website which lists professional accomplishments or professional memberships.
- NCH has an open-membership policy where membership is available for purchase to everyone. Since our organization has an open-membership policy with no acceptance process, language such as “Proud Supporter of the National Center for Homeopathy” should be used (preferred over member). If professionals choose to use the word “member” then they should include a disclaimer that states “The National Center for Homeopathy is an open-membership organization with no prerequisites to join.”
Following these guidelines helps to clarify to the public that NCH is not a professional society while lowering the number of inquiries from clients and patients to check on the status of a practicing professional’s good standing with us. It also decreases inquiries to NCH from your state’s Better Business Bureau.
To receive a high resolution CYMK transparent .PNG image of our logo, please send us URL to the page the logo will be posted and a brief explanation of how the logo will be used on your site (provide your chosen language – examples above).
25. Paper Homeopathy Today Mailing Policies
Homeopathy Today magazine is not a purchased subscription, but instead a publication mailed to NCH members as a complimentary thank you for your support. The magazine is typically published four times a year, but a certain number of editions per year is not guaranteed.
NCH Membership Dues are to be paid by the 15th of the month prior to the paper magazine mailing. As a general guide, join/renew by August 15th for the Autumn edition, by November 15th for the Winter edition, by February 15th for the Spring edition, and by May 15th for the Summer edition. Please note that delivery of the digital edition is expected to arrive 4-8 weeks prior to the delivery of a paper edition. Due to NCH’s reliance on the services of the United States Postal Service (USPS), we are unable to guarantee the delivery of the paper magazine or that it will arrive undamaged.
The purchase of a Digital Membership or Student Membership does not include a paper edition of the magazine.
If you reside outside of the USA/Canada, you must pay the International Member rate (Individual $95.00 USD / Professional $195.00 USD) in order to be mailed a paper copy of the magazine.
